About 'collections law'|Collection Law Firm Victorious Against State in Supreme Court Case
Knowledge about copyright material and copyright laws is very limited these days. Sound (or at least working) knowledge of this overlooked and misunderstood subject can yield valuable benefits to us simultaneously making the process safe and legal. You must be aware that almost all the published work today is protected by copyright laws. However, it remains a little-known fact and a surprise to many that much of this material is now a public domain due to automatic expiry of the copyright. While much of the stuff in this article is true for a majority of countries, the focus is on US copyright laws. Copyright law has evolved into a mature legislation through several amendments. Don't be overwhelmed by technical stuff though. All you have to remember are the two rules: 75 years down the line, a copyright becomes public domain material The above fact may be affected by "Sonny Bono" legislation. Simply stated, a copyright material loses its legal copyright status at the lapse of 75 years after the registration as a general rule. For example, a 1940 registration will remain protected under copyright law until 2015. Similarly, a copyright from 1922 would have expired in 1997, effectively throwing the material in public domain. The public domain is much more conducive to the overall life of the material as the material can now freely be quoted and researched. However, you need to consider the "Sonny Bono" legislation if the copyright was registered in or after 1923. This legislation was passed in 1998. It extends the copyright life for 20 more years to a total of 95 years. The legislation was triggered by Mr. Sonny Bono, a Congressman, at the event of expiry of a famous cartoon character, Mickey Mouse. Anything registered before 1922 still carried the same 75 year copyright life and was not affected by new legislation. To put the things simply and succinctly, you don't have to worry about copyright violations if the published work was registered in or before 1922. The copyright has expired and if not resold or registered again, the material is now public domain with availability for freely quoting and researching the material further. However, you need to play safe for all the material registered from 1923 onwards until the expiry of year 2018. A question might arise as to what is the utility of a material as old as 1922. You will realize that the classics in several fields like mathematics, science, music, poetry, prose, drama, and literature are evergreen and the utility never fades with the passage of time. The material remains as fresh and as useful as it was on day one. You need to pay attention to copyright information on the published work before deciding to use it freely. A publication which might look very old, may have been copyrighted fairly recently. If the copyright information is dated before 1923 though, you can use the material safely and legally by all means. Such material carries tons of information on virtually every subject. You can find such valuable publications at public libraries, personal collections, and resell bookstores. . |
